General Terms and Conditions for Consumers, 25.04.2023
(1) The following General Terms and Conditions shall apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters a legal transaction that cannot be attributed to his professional or commercial activity.
(1) The following regulations on the conclusion of the contract apply to orders placed via our Internet store https://www.dowaii.com/.
(2) In case of conclusion of the contract the contract is concluded with
Florian Taudes, B.Sc.
Donaufelderstrasse 6/6
1210 Vienna
Commercial trades with the exception of regulated commercial trades
Magistrate of the City of Vienna,
Municipal District Office for the 21st District
shall come into effect.
(3) The presentation of the goods in our internet store does not constitute a binding contractual offer in the legal sense on our part, but is only a non-binding invitation to a customer to make an offer. The customer's order constitutes an offer. A contract is only concluded after acceptance on our part. The customer will be notified of our acceptance by e-mail.
(4) The customer makes a binding offer to enter a contract by successfully completing the order procedure provided in our Internet store. An order is only possible if all mandatory fields marked with* in the order form are filled in. If any information is missing or if we cannot fulfill the order for any other reason, the customer will receive an error message. Before the final submission of the order, the customer is given the opportunity to correct his order. Supporting detailed information is given to the customer directly during the ordering process. As soon as the order process is completed, the customer is informed about it by an info window "Thank you!! Thank you so much for your purchase :) You will receive a confirmation email with the receipt shortly. Let's make the world a cuter place together :)". This does not constitute an acceptance of the customer's offer on our part. Before the binding sending of the order, the customer can, by pressing the "Back" button contained in the Internet browser used by him, after checking his details, return to the Internet page on which the customer's details are recorded and correct input errors or cancel the ordering process by closing the Internet browser. We confirm the receipt of the order immediately by an automatically generated e-mail ("order confirmation"). With this we accept the offer of the customer.
(5) The purchase contract will not be saved by us. If the customer wishes to print or save the text of the contract after placing his order, he can print or save the General Terms and Conditions available at https://www.dowaii.com/terms.
(1) The stated prices include the statutory sales tax and other price components. In addition, there are any delivery costs, which are displayed in the shopping cart before the purchase is completed.
(2) The customer has the option of payment by Stripe, PayPal, Amazon Pay.
(3) We work with an on-demand company that handles orders with facilities around the world. Depending on the shipping address, orders will be processed and shipped by the facility that can do so most efficiently. International orders may be subject to an additional customs and tax fee. This fee is beyond our control and is assessed by the local customs office. Customs regulations vary from country to country. Customers can check directly with the local customs office to find out if there are duties and taxes on their purchases.
(4) It is possible that ordered goods are temporarily unavailable. We will check the availability when you press the "Pay" button. If one of the items in the shopping cart is not available, a message will appear with the corresponding item with a request to change the order.
(1) Unless we have clearly stated otherwise in the product description, all items offered by us are not ready for immediate shipment. Since we work with an on-demand company, products must be produced after payment is received before they are ready for shipment. Delivery will be made within 20 working days at the latest.
(2) The risk of accidental loss and accidental deterioration of the sold item shall not pass to the buyer until the item is handed over to the buyer, even in the case of a mail-order purchase.
(3) The customer will receive a tracking link by email when his order is shipped.
We retain title to the goods until full payment of the purchase price.
In the event of default of payment by the customer, we are entitled to assert our rights under the retention of title. It is agreed that in the assertion of the retention of title does not constitute a withdrawal from the contract, unless we expressly declare the withdrawal from the contract.
Consumers are entitled to a right of revocation according to the following provisions, whereby a consumer is any natural person who enters into a legal transaction that cannot be attributed to his or her professional or commercial activity.
You have the right to cancel this contract within fourteen days without giving any reason.
The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.
In order to exercise your right of withdrawal, you must send us
Florian Taudes, B.Sc.
Donaufelderstrasse 6/6
1210 Vienna
by means of a clear declaration (e.g. a letter or e-mail sent by post) about your decision to revoke this contract. For this purpose, you may use the enclosed sample cancellation form, which is, however, not mandatory.
In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (except for additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.
You shall bear the direct costs of returning the goods.
You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.
